Digital Millennium Copyright Act (DMCA) Policy

At 1PcGame we value intellectual property rights and expect others to respect ours as well. Under the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their representatives can submit a takedown notice to us through our DMCA Agent, whose contact details are provided below. As an internet service provider, we are eligible for immunity from infringement claims under the DMCA’s “safe harbor” provisions.

To file a valid infringement claim, you must provide us with the following information:

Notice of Infringement – Claim Requirements

  1. A physical or electronic signature of the copyright owner or an authorized representative.
  2. Identification of the copyrighted work alleged to be infringed.
  3. Identification of the material in question and information sufficient to locate it on our site. [Please include the URL of the infringing content to help us locate the material].
  4. Contact information for the complainant, including name, address, email address, phone number, and fax number.
  5. A statement affirming that the complainant has a good faith belief that the material is not authorized by the copyright owner.
  6. A statement affirming that the information in the notification is accurate and, under penalty of perjury, that the complainant is authorized to act on behalf of the copyright owner.

Under Title 17 USC §512(f), individuals who knowingly and materially misrepresent information in an infringement notice may be liable for damages, including costs and attorney fees.

Note that we may disclose the identity and information of any copyright infringement claim to the alleged infringer. By submitting a claim, you acknowledge and agree that your identity and the details of your claim may be shared with the alleged infringer.

Counter Notification – Request for Restoration of Material

If you receive a notice indicating that your material has been removed due to a copyright claim, you may submit a counter notification to request the restoration of the material. This notification must be sent in writing to our DMCA Agent and should include the following information, as outlined in 17 USC Section 512(g)(3):

  1. Your physical or electronic signature.
  2. A description of the material that was removed and its original location before removal.
  3. A statement under penalty of perjury that you believe in good faith that the material was removed due to a mistake or misidentification.
  4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal district court in your judicial district (or, if outside the U.S., in any district where the service provider is found) and agreeing to accept service from the original complainant.
  5. Submit your counter notice through our Contact page, with email being the preferred method.

Repeat Infringer Policy

We take copyright infringement very seriously. In accordance with the DMCA’s repeat infringer policy, we maintain records of DMCA notices and make a concerted effort to identify repeat offenders. Users who repeatedly violate our policy will face account termination.
